Definitions

• Crowd Pics / we: the service offered by Blom Development, based in Grave (The Netherlands) and registered with the Dutch Chamber of Commerce under number 58891498.
• Organiser: the natural or legal person who creates an event and purchases a package.
• Guest: any visitor who uploads or views photos or videos in a gallery via the QR code or share link.
• Gallery: the digital collection point of an event where uploaded content is gathered.
• Content: all photos, videos, texts and other files uploaded through the service.
• Package: the subscription-free plan chosen by the organiser (such as Basis, Pro or Premium) with its associated limits and retention period.

Applicability

These terms apply to all use of Crowd Pics, to every offer and to every agreement between us and the organiser. By creating an event or purchasing a package, you accept these terms.

Deviations only apply if we have confirmed them in writing. We expressly reject any purchasing or other terms of the organiser.

The service

Crowd Pics enables the organiser to create an event and generate a QR code and share link. Guests can use these to upload photos and videos to one shared gallery without an app or account. The organiser can manage, moderate and download the content in full quality.

We make every effort to provide the service carefully, but this is an obligation of effort, not of result. We do not guarantee that the service is always available without interruption or error.

Account and creating an event

To create an event, the organiser needs an account. The organiser is responsible for providing accurate and complete details and for keeping login credentials confidential.

The organiser warrants that they are entitled to organise the event and that use of the service does not infringe the rights of third parties or the law.

Packages, pricing and payment

Crowd Pics works without a subscription: you pay a one-off amount per event, based on the chosen package. Current prices, limits and retention periods are listed on the packages page and apply at the time of ordering.

All prices are in euros. Payment is processed via our payment provider Mollie. The agreement is concluded once payment is completed and we have confirmed it.

Upgrading to a larger package is possible; you then pay the difference. Amounts already paid are not refunded other than under the right of withdrawal (see section 6) or mandatory law.

Right of withdrawal

If you are a consumer, you have the right to dissolve the agreement within 14 days of concluding it, without giving a reason.

Use by the organiser

The organiser is responsible for the use of their event and gallery, including communicating to guests about uploading and the use of photos. The organiser ensures that:

• guests know that their photos and videos are collected and shared in the gallery;
• there is a valid legal basis for collecting and sharing content in which people are identifiable;
• requests from data subjects (such as removing a photo) are handled in good time;
• the gallery is not used for unlawful or harmful purposes.

The organiser indemnifies Crowd Pics against claims by guests or third parties arising from the use of the gallery or the content.

Use by guests and permitted content

It is not permitted to upload content that is unlawful, offensive, discriminatory, violent, or in breach of the law or the rights of third parties, including copyright and image rights. Uploading content depicting minors in an inappropriate manner is strictly prohibited.

We reserve the right to remove content that breaches these terms and, if necessary, to block access to the service. This does not relieve the uploader of their responsibility.

Intellectual property and rights to content

Copyright and other rights to uploaded content remain with the creator, usually the guest who uploads it. Crowd Pics makes no claim to ownership of the content.

To provide the service — such as storing, displaying, resizing and making content available to the organiser — the uploader grants us a limited, non-exclusive licence that ends as soon as the content is removed from the gallery. We never use the content for our own commercial purposes, training or resale.

All rights to the service itself, including the software, design and the Crowd Pics and Blom Development trademarks, belong to us or our licensors.

Privacy and processing of personal data

When collecting photos from guests, we act as a processor within the meaning of the GDPR; the organiser is the controller. The arrangements for this are set out in our data processing agreement, which forms part of the agreement.

For the data we process to offer and manage the service (such as account and payment details), we are the controller. Read more in our Privacy Statement.

Retention period and deletion

An event's gallery remains available for the retention period of the chosen package. After that period, the content is permanently and irreversibly deleted. So make sure to download your content in full quality in good time.

The retention period starts when the event is created. We may, but are not obliged to, remind the organiser in advance that the period is about to expire.

Availability, maintenance and changes

We aim for high availability of the service but cannot guarantee it. We may temporarily take the service offline for maintenance, updates or security. We do our best to schedule this at quiet times and to limit any inconvenience.

We may further develop the service and add, change or remove features. We will not apply material changes that are detrimental to an ongoing event retroactively.

Liability

Our liability is limited to direct damage and to a maximum of the amount the organiser paid for the relevant event. Liability for indirect damage, including consequential loss, lost profits, missed savings and loss of content or data, is excluded.

These limitations do not apply to damage resulting from intent or deliberate recklessness on our part, or insofar as limitation is not permitted under mandatory law.

We are not liable for content uploaded by guests or the organiser, nor for the use they make of the gallery.

Term and termination

The agreement for an event runs until the retention period has expired and the gallery has been deleted. There is no subscription, so no cancellation is required.

We may suspend or terminate access to the service if the organiser or a guest breaches these terms or uses the service unlawfully. The organiser can have their account and associated data deleted at any time.

Changes to these terms

We may amend these terms. The most recent version is always available on this page, stating the date. For ongoing events, the terms that applied at the time of ordering remain in force, unless a change is required by law.

Governing law and disputes

These terms and all agreements are governed exclusively by Dutch law. We submit disputes to the competent court of the District Court of Oost-Brabant, unless mandatory law designates another court.
